JUSTICE PURNENDU SINGH ORAL ORDER 19-03-2024 Heard Ms. Suruchi Anand, learned counsel along with Ms. Nidhi Anand, learned counsel appearing on behalf of the petitioners and Mr. Pawan Kumar Chaurasia, learned APP for the State.

2. The petitioners seek pre-arrest bail in connection with Hajipur Town P.S. Case No. 534 of 2023 registered for the offence punishable under Sections 147, 149, 341, 323, 324, 379, 307, 354 and 504 of the Indian Penal Code.

3. As per the allegation made in the F.I.R., the

Patna High Court CR. MISC. No.84696 of 2023(3) dt.19-03-2024 2/2 petitioners along with other accused persons assaulted the informant by means of various weapons causing head injury.

4. Learned counsel appearing on behalf of the petitioners submitted that the petitioners are innocent and they have committed no offence as alleged. The injury sustained by the informant is simple in nature. Petitioners have clean antecedent.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.

6. Having heard the rival submissions made on behalf of the parties and the nature of allegation made against the petitioners, the petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 534 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
