2. Petitioner seeks bail who is in custody since 24.06.2025 in connection with Dhanaha P.S. Case No. 204 of 2025, F.I.R. dated 23.06.2025 for the offences punishable under Sections 126(2), 118(1), 118(2), 109(1) and 103(1) of the BNS, 2023.

3. According to prosecution case, the informant stated that this petitioner who happens to be the wife of the informant inflicted knife blow upon him and during the course of treatment he died.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and she has falsely been

Patna High Court CR. MISC. No.81177 of 2025(4) dt.31-01-2026 2/2 implicated in the present case and she has been made accused in the present case merely on the ground that she is wife of the deceased. He further submits that no one has seen the occurrence.

5. Learned Additional Public Prosecutor on the basis of material available on record as well as case diary has vehemently opposed the prayer for bail of the petitioner and submits that the deceased who himself is the informant in the present case stated that the petitioner has inflicted knife blow upon him and during treatment he died on 04.07.2025. Apart from the aforesaid, the postmortem report also supports the allegation as alleged in the F.I.R.

6. Considering the aforesaid facts and circumstances that there is direct and specific allegation against the petitioner supported by the medical evidence, I am not inclined to enlarge the petitioner on bail in connection with Dhanaha P.S. Case No. 204 of 2025 pending in the court of learned J.M.1st Class, Bagaha, West Champaran.
