1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 329(4), 126(2), 115(2), 74, 288, 109, 352, 351(2) and 3/61(2) and 3(5) of the BNS, 2025.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on 11.09.2025 at 07:00 AM nine accused persons including the petitioners entered his house and assaulted his family members including his mother and sister, further Md.
Patna High Court CR. MISC. No.78699 of 2025(2) dt.04-12-2025 2/3 Riyazul assaulted his younger brother by pistol causing injury on head, it is next alleged that the accused persons, in order to establish their dominance, had planned to commit the occurrence with the help of other gang members.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant, it is reiterated and submitted that petitioners are persons with clean antecedent and from the side of the petitioners, Lakho P.S. Case No. 191 of 2025 was instituted against the informant and his side. It is further submitted that as far as petitioners are concerned, the allegation against them are general and omnibus in nature.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Lakho
Patna High Court CR. MISC. No.78699 of 2025(2) dt.04-12-2025 3/3 P.S. Case No. 190 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. Accordingly, the instant anticipatory bail application is allowed.
