JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-12-2018 The petitioner seeks regular bail in connection with Pakaridayal P.S. Case No. 135 of 2017, registered for offences punishable under Sections 304(B), 120(B) and 34 of the Indian Penal Code.
Allegation is of dowry death against the petitioner, who happens to be the husband of the deceased. Submission of learned counsel for the petitioner is that the deceased was going under treatment and died natural death due to illness and also submitted that the information was given to the informant and thereafter the dead-body was disposed of and furthermore the petitioner is in judicial custody since 06.12.2017.
Heard learned A.P.P. also, who opposed the prayer for bail of the petitioner stating that nothing is found in the case
Patna High Court Cr.Misc. No.60654 of 2018(4) dt.04-12-2018 2/2 diary to show that the deceased was under treatment and there is also allegation of demand of dowry against the petitioner. Having heard both sides, in view of the above facts, I am not inclined to granted bail to petitioner. Hence, this application is dismissed.
However, since the petitioner is in judicial custody for about a year, learned court below is directed to expedite the trial.
