The petitioner seeks bail in Kahalgaon P.S. Case No. 638/2017, instituted for the offences under Sections 188 and 290 of the Indian Penal Code read with Sections 30(a), 37(c), 56(D)(E) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that 8 litres of Mahua liquor has been recovered from the house of this petitioner. Learned counsel for the petitioner has submitted that the aforesaid house is joint house in which other family members are also residing. Petitioner is in custody since 08.06.2018.

Considering the aforesaid fact and circumstances,

Patna High Court Cr.Misc. No.63817 of 2018 (2) dt.25-10-2018 2/2 prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Addl. District & Sessions Judge-cum-Special Judge (Excise), Bhagalpur in connection with Kahalgaon P.S. Case No. 638/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
