Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 22.8.2017 passed in Cr. Misc. No.33027 of 2017 with an observation to conclude the trial within a period of one year. It further appears that the petitioner was seen fleeing away from the place of occurrence. Submission of the learned counsel for the petitioner is that there is no direct allegation against the petitioner and he has been made accused only on the basis of suspicion. He is in custody since 21.10.2016 and the charge has not been framed. . Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-
Patna High Court Cr.Misc. No.70707 of 2018(2) dt.12-12-2018 2/2 (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. District and Sessions Judge, Naugachia, Bhagalpur in connection with S.T.No.198 of 2017 arising out of Dholbajja (Kadwa) P.S.Case No.34 of 2016 with condition that will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled. With the aforesaid observation, this application is allowed.
