JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This application, for grant of anticipatory bail, arises out of Complaint Case No. 1870/18, disclosing offences under Sections 323, 341 and 406 of the Indian Penal Code. Prosecution case is that the complainant has given a loan of Rs. 5,000/- to petitioner no. 1 for wheat cultivation and when she demanded her money back, petitioners said to have assaulted her.

Submission of learned counsel for the petitioners is that allegation is vague and no chit of paper has been produced

Patna High Court CR. MISC. No.76856 of 2019(2) dt.20-01-2020 2/2 by the complainant in support of her contention. Further submission is that petitioners have no criminal antecedent and they are ready to cooperate in disposal of the complaint case. Heard learned A.P.P. also.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate (West), Muzaffarpur, in connection with Complaint Case No. 1870/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is further subject to the condition that they will cooperate in disposal of complaint case and appear as and when required.
