JUSTICE ASHUTOSH KUMAR ORAL ORDER 30-09-2021 Heard Mr. Satya Prakash Parasar, the learned Advocate for the petitioner and Mr. Amrendra Kumar, the learned counsel for the complainant/opposite party No. 2. The State is represented by Mr. Umeshanand Pandit, the learned APP.

The petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1689C of 2017

Patna High Court CR. MISC. No.72951 of 2019(8) dt.30-09-2021 2/3 in which cognizance has been taken against him under Sections 498(A) of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

The petitioner is the husband of the complainant/opposite party No. 2.

This Court has been informed that a one time settlement has been arrived at between the parties. However, the payment pursuant to such agreement could not be made up-till-date now for the reason of financial constraints of the petitioner.

It has been submitted on behalf of the petitioner that he is ready to transmit the settled amount to be paid by him to the complainant/opposite party No. 2, provided her bank account number is furnished to him.

The learned counsel for the complainant/opposite party No. 2 submits that he shall be furnishing her bank account number to the petitioner shortly.

Considering the submissions afore-noted, after the settled amount has been transmitted by the petitioner in the bank account of the complainant/opposite party No. 2, the

No.72951 of 2019(8) dt.30-09-2021 3/3 petitioner shall surrender before the Court below, viz., SubDivisional Judicial Magistrate, Jamui and the Court below, on being satisfied that the agreement between the spouses has been followed, shall grant him anticipatory bail to his satisfaction on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount in connection with Complaint Case No. 1689C of 2017, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The Court below shall also ensure that the respective commitment of the parties shall be performed by them.
