The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 448 of the Indian Penal Code.

The prosecution case, in short, is that in the backdrop of land dispute, the accused persons, variously armed, assaulted the informant and other family members.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Except this, there is no other substantive evidence to suggest his implication in the present case.

Patna High Court Cr.Misc. No.60097 of 2018(3) dt.20-11-2018 2/2 On behalf of the State, it is submitted that the petitioner is named in the F.I.R. The petitioner is alleged to have assaulted the victim. The nature of injury is said to be grievous.

Considering the above, I am not inclined to grant anticipatory bail to the petitioner. The prayer is rejected. If the petitioner surrenders in the Court below and prays for bail, the same shall be considered on its own merit without being prejudiced by this order.
