Petitioners seek bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
18 litres of country made liquor was recovered from each of the petitioners. Petitioners have stated on oath that they have got no criminal antecedent. They are in custody since 24.08.2019. Investigation of the case is already complete against the petitioners. Petitioners are female. There is no material to substantiate that the petitioners are going to tamper with the evidence or abscond the process of law.
Considering the entire facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail
Patna High Court CR. MISC. No.79787 of 2019(2) dt.13-01-2020 2/2 bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No. 7603 of 2019 arising out of Dhanarua Police Station Case No. 345 of 2019, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.
(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
(c) The petitioners shall not leave the country without permission of the court.
