The petitioner seeks bail in a case registered for offences under Section 379, 411, 413, 414/34 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 9 litres of foreign liquor was recovered from a bag kept on the motorcycle which was being boarded by two persons including the petitioner. It is contended that the petitioner has no criminal antecedent. It is urged that the petitioner is in custody since 07.08.2018.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on

Patna High Court Cr.Misc. No.60241 of 2018(2) dt.06-10-2018 2/2 bail on his furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with By Pass P.S. Case No. 235 of 2018 (Arising out of Special Case No.7280 of 2018) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
