The petitioner seeks bail in a case registered for the offence under Sections 4/5 of the Explosive Act and Section 17 CLA Act and also 13 of the ULP Act. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the petitioner has been made accused in this case merely on the basis of suspicion. Nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner is rotting in judicial custody since 23.04.2019. Learned A.P.P for the State has opposed the prayer

Patna High Court CR. MISC. No.76495 of 2019(3) dt.05-03-2020 2/2 for bail and submitted that the petitioner has a series of criminal cases and altogether 13 cases have been lodged against him. Therefore, the petitioner does not deserve the bail.

Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of this petitioner is rejected. However, the petitioner may renew his prayer for bail after framing of charge.
