The petitioner seeks bail in connection with Amas P.S. Case No. 298 of 2018, registered under Sections 302, 201 and 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that on the basis of fardbeyan of informant Pappu Kumar Singh, Amas P.S. Case No. 298 of 2018, under Sections 302, 201 and 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act was instituted against unknown on 22.12.2018. In course of investigation, the name of petitioner surfaced in the confessional statement of co-accused Sujeet Kumar @ Golu. The petitioner is in custody

Patna High Court CR. MISC. No.73805 of 2019(3) dt.16-03-2020 2/2 since 29.06.2019 after remand from the another case. Further submission is that, in fact, the petitioner is accused in several cases, as detailed in paragraph No.3, due to that reasons, the Police got implicated the petitioner in the present case showing his name in the confessional statement of co-accused Sujeet Kumar @ Golu.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate, Sherghati, Gaya in connection with Amas P.S. Case No. 298 of 2018, subject to the condition that the petitioner will file an undertaking to the effect that he will appear in the trial Court on each and every date.
