JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-10-2018 The petitioner is in custody since 21.08.2018 in connection with Bhairabsthan P.S. Case No. 90 of 2018, registered for offences punishable under Sections 376 of the Indian Penal Code and Section 4, 8, 12 of the POCSO Act.
Allegation against the petitioner is of committing rape upon the minor daughter of the informant.
Submission of learned counsel for the petitioner is that the statement of girl recorded under Section 164 Cr.P.C. itself shows that she was in love affair with the petitioner and as such the petitioner has falsely been implicated in this case. Further submission is that now the case has been compromised between the parties and the petitioner is in custody since 21.08.2018. Heard learned A.P.P. also, who opposed the prayer for
Patna High Court Cr.Misc. No.60682 of 2018 (2) dt.06-10-2018 2/2 bail of the petitioner.
Having heard both sides and in view of the facts and circumstances as stated above, I am not inclined to grant bail to the petitioner.
However, once the informant is examined during the trial, the petitioner may renew his prayer for bail. Accordingly, this application is dismissed.
