2. The petitioner seeks bail in connection with Chautham P.S. Case No. 152 of 2023 registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, there is recovery of one country made pistol and five cartridges.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Learned counsel further submits that the recovery is not from the possession of the petitioner. The petitioner is in custody since 23.05.2023.

5. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.84287 of 2023(2) dt.10-01-2024 2/2 prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Khagaria in connection with Chautham P.S. Case No. 152 of 2023.

7. The petitioner will also mark attendance in Choutham Police Station, Khagaria on each Sunday of the month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U
