Mr.Md. Ataur Rahman ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Sabour P. S. Case No. 180 of 2019 registered for the offence punishable under Section 392 of IPC.

As per F.I.R. some miscreants have looted away Rs.1,67,900/- from the informant while he was going to deposit the amount. Petitioner is not named in the F.I.R., later on, his name transpires on the confessional statement of the co-accused Golu Kumar Yadav.

Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against him. He has no criminal antecedent. He is in custody for about five months. Further submission is that one mobile was recovered from him, but that belongs to the petitioner. Heard learned A.P.P. also.

No.76653 of 2019(2) dt.11-12-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Bhagalpur, in connection with Sabour P. S. Case No. 180 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition to co-operate in disposal of the trial.
