2. The petitioner seeks bail in a case registered for offence under Sections 103(1), 3(5) of the B.N.S., 2023 and Sections 27 of the Arms Act.

3. Informant suspects that at the instance of this petitioner, son of petitioner namely Dilwa Kumar and coaccused Suraj Kumar committed murder of her husband.

4. Learned counsel for the petitioner submits that informant is not an eye-witness to the occurrence and only suspicion has been raised against this petitioner because of land dispute between the parties. Except suspicion, there is no material on record to indicate involvement of petitioner in the alleged occurrence. Moreover, as per F.I.R., petitioner is not alleged to have committed murder of deceased. Petitioner has

5. Learned A.P.P. for the State opposes the prayer for bail.

Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - I, Uda-Kishunganj, Madhepura in connection with Uda-Kishunganj P.S. Case No. 428 of 2024.
