The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 366A/34 of the Indian Penal Code.
The accusation is of kidnapping of daughter of informant, aged about 16 years, by seven accused persons named in the FIR, including the petitioner with intention to perform marriage.
Learned counsel for the petitioner submits that similarly situated co-accused have been granted the privilege of bail by a coordinate Bench of this Court in Cr. Misc. No. 41230 of 2019 on 04.07.2019. He submits that there is no specific allegation against the petitioner. He further submits that

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran in connection with Taraiya Police Station Case No. 27 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
