The petitioner seeks regular bail in connection with Sherghati P.S. Case No. 300 of 2018 registered for the offence punishable under Sections 30(a) and 56(D) of the Bihar Prohibition and Excise Act, 2016.
The case of the prosecution is that upon a car apprehended by the Police and after search being made, 52.5 liters of illicit liquor was recovered and the petitioner was arrested from the spot. It has been stated in the bail petition that the petitioner has been falsely implicated in the present case and in fact alleged recovery was made from an open field. It has been further stated in the said petition that the petitioner is having a clean antecedent and is languishing in custody since

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya in connection with Sherghati Excise Case No. 300 of 2018.
