JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-10-2018 After some arguments, the learned senior counsel appearing for the petitioner seeks to withdraw the present writ petition with liberty to approach the Collector, Bhagalpur for release of the seized items by filing a petition under section 6-E of the Essential Commodities Act, 1955.

In view of the aforesaid submission made by the learned senior counsel for the petitioner, the present writ petition is disposed of as withdrawn with liberty to the petitioner to file a petition for release of the seized articles before the Collector, Bhagalpur and in case such a petition is filed within a period of four weeks from today, the Collector, Bhagalpur shall pass an order in accordance with law within a period of four weeks thereafter.

It is needless to state that in the meantime, the seized articles shall not be sold.
