JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-11-2019 This is an application for grant of anticipatory bail in connection with Shaharghat P. S. Case No. 27 of 2019, disclosing offences under Sections 341, 342, 323, 337, 354, 379, 327, 504, 506, 34 of IPC.
As per F.I.R. there is allegation against the petitioner of dashing the wife of the informant on the ground and snatched Rs.4500/- from the pocket of the informant.
Submission of the learned counsel for the petitioner is that as a matter of fact, petitioner has been brutally assaulted by the informant and others with respect to dispute of cutting the tree. The informant and petitioner both are full brothers. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,
Patna High Court CR. MISC. No.73659 of 2019(2) dt.25-11-2019 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub- Divisional Judicial Magistrate, Benipatti, Madhubani, in connection with Shaharghat P. S. Case No. 27 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
