JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-11-2018 The petitioner seeks regular bail in connection with Salimpur P.S. Case No. 167 of 2017, registered for the offence punishable under Section 414 of the Indian Penal Code. Earlier prayer for bail of the petitioner was rejected vide order dated 02.04.2018 passed in Cr. Misc. No. 18307 of 2018 by the then Coordinate Bench of this Court and there is allegation against the petitioner is of recovery of stolen motorcycle.
Submission of learned counsel for the petitioner is that petitioner has sufficiently been punished as he has been in judicial custody since 25.09.2017 and he is ready to abide by any condition imposed on him for grant of bail. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let
Patna High Court Cr.Misc. No.67435 of 2018(2) dt.28-11-2018 2/2 the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Barh, Patna/or the concerned court, where the case is pending, in connection with Salimpur P.S. Case No. 167 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
