JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 29-10-2018 There are two petitioners who are seeking production of the answer sheets of Matriculation Examination of 2018 held by the Bihar School Examination Board since they are not satisfied with the award of marks by the Board. It appears from Annexure 5 that petitioner No. 1 though had applied for scrutiny of the answer sheets, but she did not pay the requisite fee. Once, it is evident from Annexure
Patna High Court CWJC No.20336 of 2018(3) dt.29-10-2018 2/3 5 that she did not even apply for scrutiny on payment of fee, the relief which the petitioner No. 1 is seeking cannot be gone into at all.
Petitioner No. 2 appears to have paid the amount. It is not apparent whether the scrutiny has been done by the Bihar School Examination Board or not. It is the case of the petitioner No. 2 that outcome of the scrutiny has not been communicated to her.
Be that as it may, in the nature of grievance, which the petitioner has raised, I dispose of this writ application with a direction to the Controller of Examination of the Board to examine whether scrutiny of the answer sheets as applied by Petitioner No. 2 has been done so far or not and if not done, the same must be done within two weeks from the date of receipt/production of a copy of this order.
There is no provision for re-evaluation of the answer sheets. Mere assertion that the performance of these petitioners were better and the marks awarded by the examiners is less than their expectation cannot be a basis for issuance of direction for the re-evaluation unless any exceptional circumstance is made out.
This application is disposed of accordingly with the
