JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Motihari Town P.S. Case No. 490 of 2019 registered for the offences punishable under Sections 302, 327, 420, 467 and 468 of the Indian Penal Code.

As per FIR allegation against the petitioner, who is an Unani practitioner having degree of B.I.A.M.S., is that he performed operation of piles of father of informant, who later on died.

Submission of learned counsel for the petitioner is that though there is allegation that he has operated upon father of informant but no paper has been produced during inquiry and complaint case has been lodged after ore than one month of the alleged operation and he is ready to abide by any condition that

Patna High Court CR. MISC. No.73726 of 2019(2) dt.25-11-2019 2/2 may be imposed on him and since inquiry has been concluded there is no chance of tampering with the evidence. Heard learned APP also.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Motihari Town P.S. Case No. 490 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
