Petitioner, who is in custody, seeks bail in connection with G.R. No. 275 of 2018/265 of 2018 arising out of Sursand P.S. Case No. 47 of 2018 registered for the offences punishable under Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

Informant who is the police officer has alleged that when he was on patrolling duty with other police personnel he arrested Manoj Mahto with 36 liters Nepali Saufi wine on motorcycle.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Name of the petitioner has been surfaced in this case on the

Patna High Court Cr.Misc. No.61022 of 2018(2) dt.05-10-2018 2/2 basis of confessional statement of other co-accused Manoj Mahto and except that confession there is nothing against the petitioner. Nothing has been recovered from his possession. He has no concern with the alleged recovery and motorcycle. He has no criminal antecedent and he is in custody since 20.08.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi, District Sitamarhi in connection with G.R.
