Petitioner seeks bail in Patrakarnagar P.S. Case No.131 of 2018 registered under Section 395 of the Indian Penal Code.
The informant lodged the case for dacoity committed in his house against unknown. During the course of investigation, the name of the petitioner figured in the confessional statement of co-accused Ankesh Kumar recorded in the month of August, 2018 and immediately thereafter the petitioner was arrested and since 08.08.2018 petitioner is in jail. Learned counsel for the petitioner submits that dacoity was committed in the house of the informant in the month of March, 2018. The accused persons were arrested but
Patna High Court Cr.Misc. No.60052 of 2018(2) dt.28-09-2018 2/2 the name of the petitioner did not figure in the case. It is submitted that the name of the petitioner figured in the case at the instance of the police. His own brother Vishal Vikram Rana filed Cr.W.J.C. No.1407 of 2018 in which the police was reprimanded. When the case was dropped against the brother of the petitioner, the police again implicated the petitioner in a false case. Petitioner is in jail since 08.08.2018 but he has not yet been put on TIP. No looted article has been recovered from possession of the petitioner.
Taking into consideration the facts that the name of the petitioner figured in the case in the confessional statement of a co-accused but even after being arrested, the petitioner was not put on TIP although the petitioner is in custody since 08.08.2018, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge, 10th -cum-ACJM, Patna in connection with Patrakarnagar P.S. Case No.131 of 2018.
