JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-12-2019 Heard learned counsel for the appellant and the learned counsel appearing on behalf of the State. This appeal is directed against the order dated 17.09.2019 passed by the learned 3rd Additional Sessions Judgecum-Special Judge SC/ST, Bhagalpur in Mojahidpur (Babarganj) P. S. Case No.195 of 2019 registered under Sections 147, 148, 149, 342, 324, 302, 326 of the Indian Penal Code and Section 3(1)(r) 3/3(2)and (Va) of SC/ST Act.
As per allegation in the F.I.R., during marriage ceremony, the accused persons including the appellants have some altercation with the informant and further allegation is that on 15.07.2019 while the informant was going to see off his family members, this appellant called the other accused persons, they came variously armed and started firing. The specific

Submission of learned counsel for the appellant is that there are general allegation against the appellant. Except he has called the other accused persons, nothing more remains against him. He is under custody for about three and half months. Charge sheet has been submitted, so there is no chance of tampering with the evidence.
Learned Special P.P. opposed the prayer.
In view of the facts as stated above, let the appellant, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the 3rd Additional Sessions Judge-cum-Special Judge, SC/ST Act, Bhagalpur in connection with Majahidpur (Babarganj) P.
