JUSTICE PARTHA SARTHY ORAL ORDER 17-02-2020 Heard learned counsel for the petitioners, learned counsel for informant and learned Additional P.P. for the State. The petitioners have filed the instant application for grant of anticipatory bail apprehending their arrest in a case registered for the offence under sections 498A, 504, 307, 506 and 34 of the Indian Penal Code, sections 3 and 4 of the Dowry Prohibition Act and sections 3 and 4 of the Prevention of Witch Practices Act.
As per the allegation in the F.I.R, it is stated that soon after the marriage on 2.6.2013, the demand of dowry and torture by the accused persons started. Further allegation is made of the occurrences on 14.6.2013, 12.10.2018, 25.4.2019 and 14.7.2019

It is submitted by learned counsel for the petitioners that the petitioners are the father-in-law and mother-in-law of the informant. The allegations levelled in the F.I.R are general and omnibus in nature besides being false and concocted. The petitioner no.1 retired as a University Professor being the Head of Department of Geology from Tilka Manjhi Bhagalpur University. It is further submitted that petitioner no. 2 happens to be an old lady. So far as the son of the petitioners, namely Mayank Nikunj is concerned, he has already filed an application for bail in this Court being Criminal Misc. No. 80176 of 2019 which has been referred to the Patna High Court Mediation Centre by order dated 6.12.2019 passed in the said case.
It is submitted by learned counsel for the informant that there is direct and specific allegation against the petitioners in the occurrence of 14.6.2013 where they also attempted to kill the informant. It is further submitted that three rounds of meeting in the Patna High Court Mediation Centre had taken place between the informant and her husband wherein the petitioner no.1 is also cooperating. It is submitted that in view of the direct allegation, anticipatory bail may not be granted.

Having heard learned counsel for the parties and taking into consideration the totality of the allegations as levelled in the F.I.R together with the fact that application of the husband is pending and conciliation proceeding is going on in the Patna High Court Mediation Centre, the Court is inclined to enlarge the petitioners on bail. The petitioners above named, in the event of their arrest or surrender in the Court below within a period of six weeks from today in connection with Bhagalpur Mahila P.S. Case no. 38 of 2019 are directed to be enlarged on bail on each of them furnishing bail bond of Rs 10,000.- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Bhagalpur, subject to the conditions as laid down in section 438 (2) of Criminal Procedure Code.
