====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 06-10-2018 Heard Sri Tribhuwan Narayan, learned counsel for the petitioner and Mr. S.M. Rahman, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Kudra P.S. Case No.367 of 2018 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act 2016, has prayed for grant of bail, in the event of his arrest or surrender. Learned counsel for the petitioner submits that in this case, recovery of about 3 litres 60 ml of Indian Make Foreign liquor was shown from the courtyard of the petitioner, whereas the petitioner is having clean antecedent, which fact has been stated in paragraph-3 of the petition. Learned counsel for the petitioner submits that at the time of preparing seizure list, provision of Section 100 of the Code of Criminal Procedure has

Be that as it may, considering the nature of accusation as well as clean antecedent of the petitioner, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Manobriti Ram be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge(Excise), Kaimur at Bhabua in connection with Kudra P.S. Case No.367 of 2018, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J.) nawalkrs/- U T
