JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-12-2024 The learned counsel for the petitioner submits that though the respondent no.5, i.e. the Circle Officer, Dhaka, District-East Champaran at Motihari has passed the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in connection with Encroachment Case No.2 of 2022-23, however, the encroachment in question is not being removed, hence the respondent no.5 be directed to execute his order dated

Patna High Court CWJC No.18818 of 2024(2) dt.11-12-2024 3/3 18.06.2022 forthwith.

2. Per contra, the learned counsel for the respondentState submits that in case there is no other legal impediment, the respondent no.5 shall definitely enforce the aforesaid order dated 18.06.2022 and ensure that the encroachment in question is removed forthwith.

3. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the respondent no.5 to execute his order dated 18.06.2022, passed in Encroachment Case No.2 of 2022-23 and remove the encroachment in question forthwith, by taking recourse to the due process of law, in case there is no other legal impediment and if the aforesaid order dated 18.06.2022 has not been annulled by any higher forum/court of law.

4. The writ petition stands disposed off on the aforesaid terms.
