JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Shastri Nagar P.S. Case No. 595 of 2019 registered for the offences punishable under Sections 341, 323, 354B, 506,504 of the Indian Penal Code.

Admittedly, petitioner and informant are classmate and allegedly petitioner used to tease the informant and once he proposed the informant and when the informant refused to accept his proposal, the petitioner threatened him. Submission on behalf of the petitioner is that petitioner and informant are of tender age and the informant lodged this case on the pressure of his parents and moreover,

Considering the aforesaid facts and circumstances as well as submissions of the parties, let above named, petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Judge- IX cum Additional Chief Judicial Magistrate, Patna in Shastri Nagar P.S. Case No. 595 of 2019, as laid down under Section 438(2) of the Cr.P.C and furthermore, subject to condition one of the sureties must be brother of the petitioner. It is also made clear that if the petitioner makes any attempt to terrorize the victim or the witnesses of the case, the informant shall be at liberty to make prayer for cancellation of bail of the petitioner before the concerned court after giving proper information to the concerned police station.
