JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-12-2018 The petitioners seek bail in anticipation of their arrest in connection with Nathnagar P.S. Case No. 288 of 2018 dated 08.05.2018 instituted for the offences under Sections 409, 420/34 of the Indian Penal Code. One Ravi Das @ Dilip Das is said to have accepted money from several persons of the locality for the purposes of investment for earning profits. When the profits were not forthcoming, aforesaid Ravi Das @ Dilip Das was asked to return the money which he had taken from the investors. The petitioners, who are brothers of aforesaid Ravi Das @ Dilip Das are said to have physically prevented the investors
Patna High Court Cr.Misc. No.63474 of 2018(2) dt.12-12-2018 2/2 from demanding money from aforesaid Ravi Das @ Dilip Das. They are also alleged to have assaulted such investors. The learned counsel for the petitioners has submitted that petitioners are persons of clean antecedents and admittedly no money has been accepted by them. Regard being had to the aforesaid facts, the petitioners, above named, in the event of their arrest or surrender within a period of four weeks from today before the learned Court below, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar P.S. Case No. 288 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
