2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 317(2), 318(4), 341(1), 338, 336, 336(2) of the Bhartiya Nyaya Sanhita.

3. The case of the prosecution is that during vehicle, informant intercepted a motorcycle. As no paper produced, it was found that the same was stolen one. Co-accused persons, namely,Afroz Alam and Sandip Kumar were arrested. Further upon their confession, the house was raided which led to the recovery of three motorcycles.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.84946 of 2024(3) dt.07-04-2025 2/2 connection with the present case. It is further submitted that similarly situated co-accused person, namely, Sumarn Kumar, from whose possession three bikes were recovered, has been extended the privilege of bail vide order dated 13.11.2024 passed in Cr. Misc. No. 78468 of 2024 by a co-ordinate Bench of this Court. Moreover, the petitioner is languishing in judicial custody since 26.08.2024 having no criminal antecedent.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kotwa P.S. Case No. 233 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Motihari, East Champaran/concerned Court.
