JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2018 The petitioners seek regular bail in connection with Rajauli P.S. Case No. 85/1992 corresponding to Sessions Trial No. 183/1999/654/2016, registered for offences punishable under Sections 323, 341, 325, 307 and 34 of the Indian Penal Code.

This is case of misuse of privilege of bail. It appears that after closing the evidence case, 22.05.2015 was fixed for recording the statement of accused persons under Section 313 Cr.P.C., but the petitioner did not appear and thereafter, his bail bond was cancelled. After two years, he has been arrested. Submission of learned counsel for the petitioner is that he is in custody for three months and the court is vacant and he is ready to abide by any condition imposed on him.
