The petitioner seeks bail in connection with POCSO Reg. No. 40 of 2019, arising out of Mahila (Bhabua) P.S. Case No. 67 of 2019, registered under Sections 376, 341 and 323 of the Indian Penal Code and Section 6 of the POCSO Act.

The accusation is that in the morning of 30.08.2019, daughter of the informant was in the way to the house of her sister-in-law then petitioner caught hold her hand and took her forcibly in his house and locked her in the room. On weeping by the informant, her brother Niraj Bind came and she was released.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.74412 of 2019(2) dt.11-12-2019 2/2 due to dirty village politics, the petitioner has falsely been implicated in this case. Further submission is that in the statement as recorded under Section 164 Cr.P.C., the informant has clearly stated that she had gone to the house of petitioner to see him knowing that petitioner is ill and none had kidnapped her. The petitioner has no criminal antecedent and he is in custody since 01.09.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-I-cum-Special Judge, Kaimur at Bhabua in connection with POCSO Reg. No. 40 of 2019, arising out of Mahila (Bhabua) P.S. Case No. 67 of 2019. (Rajendra Kumar Mishra, J) manish/- U T
