The petitioner seeks bail in connection with Daniyawan P.S.Case No. 52 of 2016 registered under Sections 147, 148, 149 and 302 of the Indian penal Code.
Learned counsel for the petitioner submits that there is general and omnibus allegation levelled against 07 named accused persons including this petitioner and 100 unknown persons of assaulting a truck driver who had met with an accident causing death of two persons at N.H. 30A. The driver of the truck was brother of the informant. Petitioner is in custody since 25.07.2018.
From the written report itself, it is apparent that general and omnibus allegation has been levelled against this petitioner.
Patna High Court Cr.Misc. No.63752 of 2018(2) dt.26-10-2018 2/2 The other co-accused has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 17.09.2018 passed in Cr. Misc. No. 53008 of 2018.
Considering the aforesaid fact and circumstances, the prayer of bail of the petitioner is allowed. The petitioner, abovenamed, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Patna City in connection with Daniyawan P.S.Case No. 52 of 2016 with condition that both the bailors shall be the close relative of the petitioner.
