The petitioner apprehends his arrest in connection with Magadh Medical P.S. Case No.231 of 2024, registered for the offence punishable under Sections 126(2), 115, 109, 76, 352, 351(2), 324(4), 132, 3(5) of the BNS and 37 of Bihar Prohibition and Excise Amendment Act, 2022.

As per the FIR, petitioner and other co-accused persons were indulged in creating nuisance and assaulted the doctors at the emergency gate of Magadh Medical Hospital. 4.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioner is not specific rather general and

Patna High Court CR. MISC. No.84860 of 2024(2) dt.12-12-2024 2/2 omnibus in nature. Petitioner has been made accused on the basis of statement of apprehended co-accused. The injury received by the doctors are simple in nature. There is no specific overt act against the petitioner. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case as well as considering the nature of offence, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. 7.

Accordingly, this application is dismissed.
