JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2019 This is an application for grant of anticipatory bail in connection with Hulasganj P. S. Case No. 62 of 2019, disclosing offences under Sections 147, 149, 323, 341, 307, 504, 506, 379 and 354 of IPC.

As per F.I.R. there is allegation against the petitioners and other accused persons altogether 12 in number of assault to the informant and others misbehaving with the family members of the informant and also of committing theft. Submission of the learned counsel for the petitioners is that there is general and omnibus allegation against the petitioners. No specific allegation has been attributed against them. Considering the same two of the accused persons have been granted privilege of anticipatory bail by a Co-ordinate

Patna High Court CR. MISC. No.75584 of 2019(2) dt.26-11-2019 2/2 Bench of this Court, vide order dated 02.09.2019 passed in Criminal Misc. No. 54810 of 2019.

Heard learned A.P.P. as well as learned counsel for the opposite party no.2, who has appeared suo motu and has opposed the prayer for anticipatory bail on the ground that injuries are grievous in nature and there is old enmity between the parties.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jehanabad, in connection with Hulasganj P. S. Case No. 62 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
