JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2018 The petitioner seeks regular bail in connection with Mahua P.S. 14/2016 corresponding to Sessions Trial No. 225/2018, registered for offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
Earlier bail application of the petitioner was rejected by this court vide order dated 07.02.2018 passed in Cr. Misc. No. 54638/2017.
Submission of learned counsel for the petitioner is that up till now charge has been framed and no witness has been examined which will appear from the report of District & Sessions Judge, Vaishali at Hajipur and there is no direct evidence against the petitioner who happens to be a lady. Heard learned A.P.P. also.
Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.64444 of 2018(3) dt.20-11-2018 2/2 circumstances of the case, I am not inclined to grant bail to the petitioner above-named.
However, charge has been framed, the District & Sessions Judge, Vaishali at Hajipur is directed to expedite the trial and conclude the same as soon as possible. (Vinod Kumar Sinha, J) vinita/- U T
