Petitioner apprehends his arrest in connection with Hilsa P.S. Case No.287 of 2019 for the for the offence punishable under Sections 341, 323, 504, 420, 406 read with 34 of the IPC.

Learned counsel appearing for the petitioner submits that petitioner has committed no offence and has falsely been implicated in this case. In fact the petitioner happens to be a qualified doctor and he has properly operated the victim as per the need of treatment. As a matter of fact the occurrence took place in January, 2019 whereas the instant FIR has been lodged on 20.06.2019 after lapse of almost six months without

Further submits that no such occurrence has ever taken place as alleged and the informant has not mentioned any specific instance of medical negligence on the part of the petitioner. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on anticipatory bail in the event of his arrest or surrender in the Court below within a period of four weeks in connection with Hilsa P.S. Case No.287 of 2019 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa at Nalanda, subject to the conditions as laid down in section 438(2) of Criminal Procedure Code.
