2. The petitioner seeks bail in connection with Sabour P.S. Case No. 397 of 2024, instituted for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 140(1), 352, 351(4), 61(2) of the Bharatiya Nyaya Sanhita, 2023, read with Sections 25(1-B)(i), 9, 26, 35 and 27 of the Arms Act.
3. The prosecution case, in short, is that during morning patrol the informant received news that 20-25 armed miscreants at Lailakh Bahiyar opened indiscriminate fire on the villagers of Shankarpur. They have kidnapped and injured one villager namely Sitaram Mandal, intending to kill him. With the help of police force, 12 of the armed suspects were captured

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submits that no specific allegation has been attributed against the petitioner rather the same is general and omnibus in nature. It is next submitted that the injury sustained by the injured is found to be simple in nature. The petitioner is in custody since 04.09.2025 and has got one criminal antecedent in which he has been acquitted. Learned counsel for the petitioner further submits that other co-accused has been granted regular bail by this Court vide order dated 24.04.2025 passed in Cr. Misc. No. 22309 of 2025.
5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two
