The petitioner seeks regular bail in connection with Sadar P.S. Case No. 483 of 2019, registered for the offence punishable under Sections 420 and 406/34 of the Indian Penal Code.

The allegation is regarding the petitioner, being the owner of the truck, having transported maize, after lifting the same from the company of the informant and the maize was then dropped at a go-down at Forbisganj, however, some portion of the maize is said to have been rejected and the petitioner was required to bring it back to the company of the informant, however, instead, it is alleged that the petitioner had not only misappropriated the balance quantity of maize but had also lifted the balance quantity of

Patna High Court CR. MISC. No.74886 of 2019(2) dt.04-12-2019 2/2 rejected maize of another truck resulting in a loss of about Rs. 5,50,000/- appropriately.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, he is having a clean antecedent and he is languishing in custody since 15.10.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No. 483 of 2019. It is further directed that the petitioner would mark his attendance before the Officer-in-Charge of the concerned police station at 10:00 am. on each Monday of the week, till submission of the charge-sheet and in the event of two consecutive defaults, the present privilege of the regular bail shall stand cancelled automatically.
