====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in connection with Aurangabad (Nagar) P.S. Case No.211 of 2018 registered under Sections 188 and 414 of the Indian Penal Code besides Section 52 of the Prisoner Act.
The accusation is that in course of jail checking, the petitioner being the convict was found in possession of two mobile sets without SIM.
Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner was in custody after conviction in Mohania P.S. Case No.80 of 2012 and sentence of seven years of the petitioner in that case has already been
Patna High Court Cr.Misc. No.62416 of 2018(2) dt.06-10-2018 2/2 completed on 02.10.2018. Further submission is that the petitioner is accused in five other cases, out of which he has been acquitted in Dehri P.S. Case No.121 of 2012 and in four other cases, he is on bail.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (Nagar) P.S. Case No.211 of 2018. Out of the two sureties, one must be the close relative of the petitioner.
