2. Petitioner apprehends their arrest in a case registered for the offence punishable under sections 126(2), 115 (2), 118 (1) , 117 (2), 74, 352, 329 ( 4 ), 351 ( 2 ) 3 (5) of Bhartiya Nyay Sanhita ( B N S ) Act.
3 . The prosecution case in brief, is that on the alleged date and time of occurrence , this petitioner who is son-in - law of co-accused Virendra Yadav in drunken state came to the house of informant and assaulted on the head of mother of informant with iron rod.
4. It is submitted on behalf of the petitioners that infomant and father-in - law of the petitioner are full brother and due to dispute over family roperty a simple occurrence of
Patna High Court CR. MISC. No.83804 of 2024(3) dt.27-01-2025 2/2 quarrel took place between both the parties. Petitioner is son - in - law of co-accused Virendra Kumar and he was not present at the place of occurrence . F.I.R., has been lodged after delay of 6 days for which there is no explanation . Though it is alleged that this petitioner assaulted mother of informant but there is no injury report on the record. Petitioner claims clean antecedent. 5 . Learned counsel for the informant opposed the bail petition .
6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM VII Bhojpur at Ara in connection with Ara Muffasil P.S. Case No. 244 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 . (Prabhat Kumar Singh, J) Koushik/- U T
