The petitioners seek bail in Jagdishpur P.S.Case No.179 of 2018 registered for the offence under Section 302/120(B)/34 of the I.P.C.

Accusation is that in the morning of 13.05.2018 the informant Nand Kishore Yadav, Chaukidar, started searching his elder son, Rambali Singh, after puja but he could not find him. Then in course of search he went near the field of vegetable where he found his son in sleeping condition but when he shook him he found him smeared with mud. Further he came to know from the people of his vicinity that in the preceding night at 8 P.M.his son was seen taking supper with his neighbour Sumeshwar Mushar thereafter in the house of his servant Shambhu Mushar @ Dubhar

Patna High Court Cr.Misc. No.62474 of 2018 (2) dt.08-10-2018 2/2 Mushar son of the informant was also seen in the feast on the eve of marriage of the son of his servant and thereafter this petitioner along with the other accused persons strangulated the deceased in the wet field and put his dead body on the Machan. Submission on behalf of the learned counsel for the petitioner is that the petitioner who happens to be the servant of the informant has been falsely implicated in the present case in course of investigation on suspicion raised by the informant, he was arrested by the police showing his involvement and he is in custody since 15.05.2018.

Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the A.C.J.M.
