2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 190, 191(2), 115(2), 126(2), 117(2), 352, 109(1) of the Bharatiya Nyaya Sanhita.
3. Learned counsel for the petitioners submits that the petitioners have antecedent of two cases but then one case was instituted by the side of the informant. It is next submitted that informant alleges that on 03.07.2025 he was getting work done

No.80339 of 2025(2) dt.09-12-2025 2/3 in the house when his uncle's son along with named accused persons including the petitioners came and started putting brick, on objection, Kiran started pelting stone from the terrace causing injury on his head, while Awadhesh and Jairam caught his father and Dinesh and Ranjit assaulted him by lathi causing injury on head and fracture of left hand and the accused persons also assaulted his mother Gita.
4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the instant case by the informant. It is next submitted that the petitioners and the informant are relatives and are having dispute relating to land. It is further submitted that Dinesh and Ranjit are alleged to have assaulted the father of the informant but, then his injury has been opined to be simple which amply demonstrates that the accused never had any intention of committing a serious occurrence. It is next submitted that Awadhesh and Jairam have been implicated with fundamental allegation that they have caught the father of the informant. It is next submitted that the injury of informant has been opined to be grievous but the same was caused on account of assault made by bricks by Kiran who is not a petitioner in the anticipatory bail application.
5. Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.80339 of 2025(2) dt.09-12-2025 3/3 anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Chandi (Wena) P.S. Case No. 347 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
