This is a case registered under Sections 363, 366A, 376, 216, 120B of the Penal Code read with Sections 4/6 of the Pocso Act pending in the Court of Special Judge (Pocso Act), Darbhanga .

This is second attempt on behalf of the petitioner. This Court would find that the victim, minor girl, in her statement under Section 164 Cr.P.C. has specifically alleged regarding rape committed by the petitioner. The petitioner has been in custody since 17.9.2017.

In view of the seriousness of the allegation made against the petitioner this Court is not inclined to allow his

Patna High Court Cr.Misc. No.62844 of 2018(4) dt.28-11-2018 2/2 prayer for bail.

This Court, however, would observe that the trial court should expedite the trial in the court below without granting any unnecessary adjournment so as to conclude the proceedings expeditiously.

The prayer for bail is rejected.
