In this case, the petitioner is seeking anticipatory bail in connection with Complaint Case No.251 of 2016, registered for the offence punishable under Sections 498 (A), 323, 506 of the Indian Penal Code.

Allegation against the co-accused including the petitioner is to have demanded the dowry and due to nonfulfillment of demand of dowry, the complainant has been toured.

Counsel for the petitioner submits that the

No.75243 of 2019(2) dt.25-11-2019 2/2 complainant has got second marriage with one Premlal Tatma left the husband and children and now she does not want to live with her husband, which is apparent from affidavit of her brother and report of Gram Panchayat (Annexure-2 and 2/1). Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Katihar in connection with Complaint Case No.251 of 2016, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
