JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22.11.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 302 and other minor sections of the IPC. The impugned order of learned Sessions Judge goes to show that it was co-accused Munna Chaurasiya who gave fatal blow to the deceased and so far as the petitioner is concerned, no specific overt-act has been attributed against him. Moreover, some co-accused, having more or less similar allegation, have already been granted privilege of bail by different benches of this court.

Accordingly, petitioner is directed to be released on

Patna High Court Cr.Misc. No.66011 of 2018 (2) dt.22-11-2018 bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Bettiah, West Champaran in Gaunaha P.S. Case no. 108/2014.
