Petitioner apprehends his arrest in connection with Abadpur P.S. Case No. 141 of 2019 registered for the offence punishable under Section 380 of the Indian Penal Code. Cash, jewellery and some household articles are said to have been stolen from the house of the informant by some unknown miscreants.
It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He is not named in the FIR. No stolen articles have been recovered from conscious physical possession of the petitioner. There is nothing cogent on record indicating complicity of the
Patna High Court CR. MISC. No.72891 of 2019(2) dt.18-12-2019 2/2 petitioner in the occurrence barring the confessional statement of co-accused Firoj Alam. The articles seized from the house of the petitioner are the household articles of the petitioner and easily available in the market. Aforesaid articles were not put on T.I.P. Said Firoj Alam has been enlarged on bail by the learned court below. Petitioner has no criminal antecedent. On the other hand, learned APP opposed the bail prayer of the petitioner.
In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-1st Class, Katihar in connection with Abadpur P.S. Case No. 141 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Prakash Chandra Jaiswal, J) rohit/- U T
